1. Introduction and Acceptance of Terms

Welcome to Brum Outloud (the Website). The Website is operated by Brum Outloud (we, us, or our). By accessing or using the Website, you agree to be bound by these Terms and Conditions (Terms), our Privacy Policy, and our Terms of Submission. If you do not agree to these Terms, you must not use the Website.

2. Services Provided

Brum Outloud provides a platform for discovering LGBTQ+ events and venues in Birmingham. We aim to be a comprehensive guide, but we do not organize, host, or endorse all events or venues listed. Our role is solely to provide information based on submissions and publicly available data.

3. User Obligations

As a user of the Website, you agree to:

  • Use the Website only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Website.
  • Provide accurate and truthful information when submitting content or using our contact forms.
  • Comply with all applicable local, national, and international laws and regulations.

4. Accounts and Email

How an account works. There is no password. You give us an email address and we send a one-time sign-in link; clicking it signs you in and creates the account if you did not already have one. That link is personal to you — anyone who can read your inbox can use it, so please keep your email account secure and do not forward sign-in links to other people.

What an account is for. Saving what you would like us to lead with, your accessibility settings, and whether you want the email. Preferences change the order things are shown in; they never hide events from you, and the full listing stays the full listing.

The email is opt-in. We only email you about events if you have asked us to, and confirming is a separate step from creating the account — you confirm by clicking the link we send to your address. There are two separate choices: the general what’s-on email, and email about the kinds of night you have picked, which can include adult, kink and fetish events. You can turn either off without affecting the other.

What we do not promise. We do not commit to a fixed number of emails, a schedule, or a particular mix of events — a quiet week may mean no email at all. We may change what the email contains, or stop sending it, at any time.

Stopping. Every email carries a one-click unsubscribe link, and you can change the same settings on your account page at any time. You can delete your account, and everything stored against it, whenever you like — there is a link on the account page and it takes effect immediately.

Suspension. We may suspend or remove an account that is being used to abuse the Website, other users, or the people whose events we list.

5. Intellectual Property

All content on the Website, including text, graphics, logos, images, and software, is the property of Brum Outloud or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

6. Disclaimers and Limitation of Liability

  • Information Accuracy: While we strive for accuracy, Brum Outloud does not warrant that the information on the Website (including event details, venue information, and opening hours) is complete, accurate, or current. We rely on third-party submissions and publicly available data, which may change without our knowledge.
  • Third-Party Links: The Website may contain links to third-party websites. These links are provided for your convenience only. We have no control over, and are not responsible for, the content, privacy policies, or practices of any third-party websites.
  • No Endorsement: Listing an event or venue on Brum Outloud does not constitute an endorsement or recommendation by us. Users should exercise their own judgment and discretion when attending events or visiting venues.
  • Limitation of Liability: To the fullest extent permitted by law, Brum Outloud shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Website; (ii) any conduct or content of any third party on the Website; (iii) any content obtained from the Website; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

You agree to defend, indemnify, and hold harmless Brum Outloud and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Website, or a breach of these Terms.

8. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Website after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Website.

9. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
